Manitoba - Regulation Amendment

The publication of M.R. 128/2019 on October 1, 2019 brings changes to the Workplace Safety and Health Regulation with two specific areas relevant to dealers - 1) committee minutes & 2) drug and alcohol related hazards.

The first significant change is that the Workplace Safety and Health Committee Minutes will no longer be required to be sent to the Workplace Safety and Health Branch.

Subsection 3.7(2) of the Manitoba Workplace Safety and Health Regulation previously stated that "An employer or prime contractor must, within seven days of receiving a copy of the minutes of a committee meeting, ensure that a copy is sent to the branch and to each committee member."


It has now been amended to "An employer or prime contractor must, within seven days of receiving a copy of the minutes of a committee meeting, ensure that a copy is sent to each committee member.


The next significant change is the addition of drug and alcohol related hazards to Part 2 - General Safety Duties, which reads as follows:


Alcohol and drug consumption


2.19(1) An employer must take all reasonable steps to ensure that a worker does not work while under the influence of alcohol or a drug that impairs or could impair the worker's ability to perform work safely.


2.19(2) A worker must not work while under the influence of alcohol or a drug that impairs or could impair the worker's ability to perform work safely.
